工具機大廠、上銀董事長卓永財日前砲轟政府的一例一休政策,指現在在周日加班要付3倍
薪水,還要給補休假,獲利再好也沒有這樣,「又不是印鈔票的」。但勞動部今發布新聞
稿澄清,《勞基法》並沒有這樣的規定。
勞動部說,依《勞基法》規定,僅說勞工每7日中要有2日休假,其中1天為例假,1天為休
息日,但這兩天是由勞資雙方自行約定,並沒有硬性規定周六是休息日、周日是例假。
勞動部解釋,若例假當天,因天災、事變、突發事件等僱主須使勞工出勤,僱主除應發給
當日工資外,還要再加發一天工資,並於事後補假休息。
若是休息日要求勞工加班,加班費是前2小時按平日每小時工資額另再加給1又3分之1倍以
上,超過2小時後,按平日每小時工資額另再加給1又3分之2倍以上 ,且未滿4小時一律以
4小時計,勞僱雙方同意後可換補休。
勞動部說,目前《勞基法》並未規定勞工休息日加班,僱主要給加班費又要給補休。(唐
